Dynasty Limited Warranty:

2005 Neighborhood Electric Vehicle

1.  WARRANTY COVERAGE PERIOD

Dynasty Electric Car Corp.  (DECC) warrants from the date of delivery to the first consumer, that each 2003 DECC Neighborhood Electric Vehicle (NEV) sold as “NEW and “UNUSED” and pre-delivered by an authorized DECC dealer, will be free from any defect in material and /or workmanship for a period of:

ONE (1) Year

Except as otherwise provided herein:

            Parts covered by the original manufacturer’s warranty

• Batteries
• Tires
• On Board Computer

DECC will repair or replace, as its option, all genuine DECC parts found faulty in material and / or workmanship under normal use, maintenance and service, with a genuine DECC part, at any authorized DECC NEV dealer, during warranty coverage period.     DECC will reimbursed repair labor at our published warranty rate and factory authorized times.   

All genuine DECC accessories are warranted with respect to parts against defects in materials and workmanship for a period of 90 days from the date of purchase to original purchaser.

2. EXCLUSIONS

• Normal wear and tear items such as the charger plug and receptacle, seats, windshield wiper blades, trim pieces, fuses, decals (except safety decals), brake shoes, belts, brushes, bushings, light bulbs, mats and pads, cosmetic deterioration, and items which deteriorate or fail due to exposure;
• Damage caused by failure to provide proper service, maintenance and / or storage, as described in the Dynasty Electric Car Corp. owner’s manual;
•  Damages resulting from improper repairs, modifications or use of non-approved parts or repairs done by a non-authorized DECC NEV dealer;
• Damage resulting from continued use of the vehicle after a defect is or should have been discovered;
• Damage resulting from accident, fire, theft, vandalism or any act of God;
• Damages to batteries or loss of autonomy resulting from lack of appropriate charge or from a freezing or high temperature condition;
• Damage related to gel coat finish, including but not limited to cosmetic gel coat finish, blisters or fiberglass delaminating caused by blisters, crazing, spider, or hairline cracks.
• Transportation expenses for warranty services and shipment of warranty parts are also excluded from this limited warranty.

  This warranty gives you specific rights, and you may also have other rights, which vary from state to state (province to province).  The laws of the Province of British Columbia govern this warranty.  This document contains the entire warranty given by Manufacturer and there are no terms, promises, conditions or warranties other than those contained herein.  No oral or written information or advice given by Manufacturer, its dealers, representatives, agents, or employees shall create a warranty or in any way increase the scope of this warranty.  Manufacturer does not authorize any person to extend the time of the warranty or to create or assume for it any other obligation or liability with respect to its products.  No person, including a dealer, is authorized to make any repairs or replacements under this warranty without the prior written approval of Manufacturer.   Manufacturer reserves the right to improve its products through changes in design, material or parts without being obligated to incorporate such changes in design, material or parts without being obligated to incorporate such changes in products previously manufactured.  This warranty is not transferable or assignable.

  Express or Implies Warranty:

  THIS EXPRESS WARRANTY IS IN LIEU OF, AND MANUFACTURER DISCLAIMS, ANY AND ALL OTHER WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, WHATSOEVER INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES UNDER THE UNIFORM COMMERCIAL CODE, ANY IMPLIED WARRANTY OR MERCHANTABILITY AND ANY IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.  THIS WARRANTY SHALL BE THE SOLE AND EXCLUSIVE REMEDY OF MANUFACTURER SHALL NOT BE LIABLE FOR CONSEQUENTIAL, SPECIAL OR INCIDENTAL DAMAGE RESULTING FROM A BREACH OF THE EXPRESS OR ANY IMPLIED WARRANTYWHICH IS NOT DISCLAIMED HEREIN NOR ANY OTHER LOSS OR DAMAGE, EXCEPT AS SET FORTH ABOVE.

  In the event that the disclaimer and exclusion of warranties and damages are inconsistent with applicable law, those disclaimers and exclusions are limited to the maximum permitted by applicable law, and all remaining implied obligations and warranties are limited to a duration period of two (2) years or such shorter period as permitted by applicable law.

  Some states (provinces) do not allow limitations on implied warranties, or the exclusion or limitation of incidental or consequential damages, so the limitations or exclusions may not apply to you.
