ZENN Motor Company Vehicle Warranty

1. CUSTOMER DISCLOSURE
   
   Zenn Motor Company (ZMC) as well as ZMC Retailers make the terms of the warranty available for review to prospective customers and a copy of the warranty is provided with each vehicle upon sale. ZMC is responsible to provide the collateral material and the Retail is responsible for communication and distribution.
   
2. NEW CAR WARRANTY
   
   ZMC will repair or replace, at its option, all genuine ZMC parts found faulty in material and/or workmanship, under normal use, maintenance and service, with genuine AMC parts without charge for parts and labor, at any authorized ZMC Retailer during the warranty coverage period.
   
   This warranty begins on the date the car is delivered to the first purchaser other than an authorized ZMC Retailer, or the date it is first used as a demonstrator, lease or company vehicle whichever comes first. This warranty applies to vehicles sold as new and unused by an authorized ZMC Retailer.
   
   The warranty applies only to the original purchaser and may be transferred to subsequent purchasers or lessees if a warranty transfer is performed by an authorized ZMC Retailer.
   
   Time and Distance Period
   
   ZMC warrants each ZENN vehicle will be free from defects in material and/or workmanship for a period of one (1) year or 5,000 miles whichever comes first.
   
   1. ZMC warrants from the date of delivery to a rental or car share program that each ZENN vehicle will be free from any defect in material and/or workmanship for a period of ninety (90) days.
      
3. THIS WARRANTY DOES NOT COVER'
   
   • Parts and labor required for normal maintenance items including brake adjustments, wheel alignment, tire rotation, tightening of nuts, bolts and fittings, headlight alignment, and general adjustments which may be performed from time to time.
   • Deterioration due to normal wear and tear and exposure including windshield wiper blades, brake shoes and pads, tire wear, triam pieces, body panel scratches, cracks or fading, charger plug receptacle wear, motor brushes, bushings, bushings, light bulbs, and mats.
   • Surface rust and deterioration of paint, trim, upholstery, and other appearance items that result from use and/or exposure to the elements.
   • Damage to tires, paint, body panels, glass, and other exterior items due to environmental conditions or road hazards including markes from road stones.
   • Warrantable defects and/or road hazard for tires.
     
     
4. WARRANTY
   
   • Damage caused by failure to provide proper maintenance and or service including continued use of the vehicle after a defect is orshould have been discovered.
   • Damage or failure resulting from improper modifications or tampering to the body, chassis, electrical or mechanical systems.
   • Damage resulting from the use of non-approved tires or rims.
   • Damage resulting from the use of tire chains.
   • Any vehicle on which the odometer has been altered, modified or remodeled so that the true distance traveled cannot be determined.
   • Any repairs required as a result of remodeling or modification made to accommodate or install any accessories, parts, or devices wich have not been tested and approved by ZMC.
   • Any repairs required as a result of non-approved ZMC parts and or use of a non-authorized ZMC Retailer.
   • Any repairs or service required as a result of a collision, accident, fire, explosion, theft, vandalism, riot or any other act of God.
   • Misuse of the vehicle including overloading, racing, use as a tow vehicle, driving over curbs, driving through water deep enough to cause electrical system damage.
   • Vehicles which for any reason have been declared a total loss or solf for salvage purposes or reconstruction.
   • Customer-applied chemicals or accidental spills.
   • Using contaminated or improper fluids.
   • Physical damage resulting from being towed on an open trailer.
   • Damage resulting from being towed with the tires in direct contact with the pavement.
   • Damage to the batteries due to too deep of a discharge, infrequent use, charging with unapproved battery chargers, pack imbalance resulting from partial pack replacement, or from freezing conditions after a deep discharge.
   • Transportation expenses for warranty services.
   • Vehicles exported outside the United States and Canada.
     
     
5. ACCESSORY LIMITED WARRANTY
   
   This warranty applies only to genuine ZMC accessories distributed and installed by an authorized ZMC Retailer within the USA.
   
   Accessories purchased from an authorized ZMC Retailer at the time of original purchase of the vehicle by the first customer will be warranted as per the following conditions for a period of one (1) year or 5,000 miles (whichever comes first) from the date the car is delivered to the first customer or the date it first became a demonstrator, lease or company-driven vehicle. Certain accessories may have additional warranty provision beyond this period which will be honored in accordance with the specific warranty provisions for the accessory.
   
   ZMC will repair or replace, at its option, all genuine ZMC accessories found faulty in material and/or workmanship, under normal use, maintenance and service, with genuine ZMC parts without charge for parts and labor, at any authorized ZMC Retailer during warranty coverage period.

ZENN factory-installed Sunroof Warranty

ZMC will repair or replace the factory-installed sunroof for any defect in material or workmanship to the original purchaser from the date of new vehicle delivery for a period of three (3) years or 36,000 miles, whichever comes first. This warranty applies to vehicles sold as new and unused to a retail customer for repairs at an authorized ZMC Retailer. Tis warranty is subject to the same exclusions as the ZENN new car limited warranty. The sunroof warranty is not transferable to subsequent owners.

1. SOLE REMEDY
   
   ZMC's only liability under this warranty, or in any action whether based upon its warranty, contract, negligence, strict product liability or otherwise, is limited to the repair or replacement, at ZMC's option, of a vehicle or component thereof that ZMC deems to be defective. Replacement shall mean furnishing, during the applicable warranty period, a new vehicle or factory-reconditioned vehicle or component thereof which is identical or reasonably equivalent to the warranted product or component at no cost to the purchaser. Repair shall mean remedying a defect in the vehicle or component thereof at no cost to the purchaser during the applicable warranty period. If ZMC elects to repair the vehicle, it may provide factory reconditioned parts or components. All parts and components replaced under warranty shall become the property of ZMC.
   
2. VOIDING OF THE WARRANTY
   
   This warranty shall be null and void with respect to any defect or damage caused by, related to, or as a result of:
   • Any modifications or changes to the vehicle by any person whatsoever that changes or alters the following;
   • Weight distribution
   • Speed limitation - any indication that the speed governor was modified or adjusted beyond ZMC facory specifications.
   • Use of non-genuine or non-authorized ZMC parts;
   • Any alterations or modifications to the steering, transaxle, engine, transmission, controller, charging system or othe operating systems beyond ZMC factory specifications;
   • Abuse of the vehicle - Any indication that the vehicle was used in a manner not intended for the vehicle as set forth in the ZENN Owner's Manual, intended or unintended;
   • If the maintenance is not peformed at the intervals and manner set forth in the ZENN Owner's Manual.

WARNING: The above-mentioned modifications may cause injury to persons and property and are prohibited by ZMC. ZMC disclaims any and all responsibility for such modifications or alterations. These modifications and alterations may adversely alter the safety of the vehicle.

DISCLAIMER (1)

• This warranty is exclusive and is made in lieu of any and all other warranties of any kind, whether express or implied including any warranty of Retailer and vehicle ability of fitness for a particular purpose which exceeds the purposes and time limits set forth in the ZENN Owner's Manual are also hereby disclaimed by ZMC and are excluded from this warranty.
• ZMC also will disclaim any liabilities for incidental or consequential damages, including but not limited to, injury to property or persons, loss of time, inconvenience, economic loss, coming about from vehicle defects.
• The purchaser and ZMC expressly agree that the remedies set forth in this document, the repair or replacement of the vehicle defects, components or the entire vehicle is the sole remedy of the Retailer and purchaser and ZMC makes no other representations or warranties of any kind.
• No agent, Retailer, representative or employee of ZMC, or any other person has the right or authority to make, imply or assert any representation, agreement, prmise or warranty which in any way modifies or changes the terms of this warranty or the products sold under this warranty.
• ZMC reserves the right to change or modify this warranty agreement at any time and it is understood that the changes or modifications will not affect vehicles sold under the existing warranty at time of sale.
• ZMC's one (1) year warranty may be transferred for a fee under the following conditions;
  
• Warranty in its entirety will not exceed 12 months from the original owner's date of delivery or 5,000 miles, whichever comes first.
• Battery warranty voids on transfer.
  
• Some states have legislation that does not allow limitations on the term of a warranty or the exclusion or limitation of consequential damages, so the following limitation may not apply in your case. This warranty does give you specific legal rights and depending on the state you may have additional or other rights, which may vary.
